Is Sports Betting Legal in California? Laws in 2026

No, traditional online and retail sports betting is not legal in California. The state has no authorized sportsbook market, including at tribal casinos. A sportsbook account, a downloadable app or a licence issued elsewhere does not authorize a wager placed in California.

There is also no approved California sportsbook launch date. The state's official list of qualified November 2026 ballot measures contains no sports betting proposal as checked on October 11, 2026. Fantasy contests, prediction markets and horse racing require separate explanations. They should not be grouped together as if California had approved them all under one betting law.

Why is sports betting illegal in California?

California Penal Code section 337a prohibits bookmaking and specified conduct involving wagers on contests of skill, speed or endurance. Its reach includes more than running a commercial betting operation: the text also addresses receiving, recording, making and accepting covered wagers, subject to its exceptions.

There are separate permissions for other activities. The California Constitution provides for regulated horse-racing wagering and specified tribal casino gaming. Those exceptions do not establish a general market for betting on football, basketball or other sports through a sportsbook.

This explains why a tribal casino can lawfully offer authorized casino games without operating a legal sports betting counter. The venue's tribal status does not make every proposed gaming product permissible. Similarly, the California Horse Racing Board's account wagering list concerns horse-racing wagering. It does not license other sports products under the same brand.

The relevant question is therefore not simply whether California permits gambling somewhere. It is whether the particular activity has legal authorization. California's Gambling Control Commission directs people with complaints about licensed sports wagers placed in another state to that state's regulator, while separately identifying reporting routes for illegal California sportsbook operations.

Can you use DraftKings or FanDuel Sportsbook in California?

DraftKings Sportsbook and FanDuel Sportsbook are not authorized to accept traditional sports wagers placed in California. Neither a licence held in another state nor an account opened there changes California's sportsbook restrictions.

The word Sportsbook matters. A brand may offer fantasy contests, event-contract trading, free games or sports information through separate services. An advertisement saying that a brand is available in California may refer to one of those products rather than its sportsbook.

Read the product name, operator or exchange details and terms before drawing a legal conclusion. A fantasy contest is not a licensed California sportsbook; an event contract raises a different regulatory question. Neither should be used to claim that California has legalized traditional online sports betting.

California has no approved date for legal sportsbook betting to begin. As of the October 11, 2026 check, the Secretary of State's qualified November 2026 ballot list does not include a sports betting measure.

A forecast mentioning 2028 is a forecast, not permission to bet and not a confirmed launch schedule. Any future proposal would need to be assessed on its actual text, approval route and implementation requirements. A political agreement or announcement alone would not establish an operating market.

1. A proposal exists

Read the actual initiative or legislation. An announced plan is not an enacted rule.

2. Authorization is approved

Check the official vote or legislative record and when the approved provisions take effect.

3. Operations are permitted

Confirm the required regulatory approvals and which services have actually opened.

Those stages prevent three common errors: treating a proposed year as a deadline, treating approval as an immediate launch, and assuming every operator will be allowed to participate. The eventual framework could contain different requirements for online betting, retail venues and tribal participation.

For a current check, open the Secretary of State's qualified ballot measures. The page also links to initiatives still attempting to qualify. A proposal appearing in that earlier process is not the same as a qualified ballot measure or an approved law.

What happened to Propositions 26 and 27?

California voters rejected both sports betting propositions in November 2022. They proposed different approaches, and neither created permission to operate a sportsbook.

2022 proposal Approach put to voters Result
Proposition 26
In-person sports wagering as part of a proposal involving tribal gaming
Defeated: 67.0% voted no.
Proposition 27
Online and mobile sports wagering outside tribal lands
Defeated: 82.3% voted no.

The official declaration of results records both defeats. These are historical ballot measures, not pending bills awaiting a governor's signature.

The distinction remains useful when reading old articles. A 2022 description of what a proposition would allow describes the proposal, not California's current rules. Likewise, the existence of two competing models does not establish what a future measure will contain.

Are fantasy sports, prediction markets or sweepstakes different?

Daily fantasy sports

The California Attorney General's July 2025 opinion concludes that operating daily fantasy sports contests for players physically in California violates Penal Code section 337a. Its analysis covers both draft-style contests and pick'em formats, regardless of where the operator or servers are located.

This is an attorney general opinion, not a new statute or a final court judgment resolving every possible contest. However, it directly contradicts a simple claim that all DFS is legal merely because an app accepts California users. It should also not be extended automatically to every private season-long league.

Prediction markets

Prediction markets offer event contracts, and the CFTC asserts federal oversight of covered derivatives trading. That federal framework is distinct from California sportsbook licensing.

Sports event contracts also face legal disputes. In September 2026, the Ninth Circuit held that two tribes were likely to succeed on claims concerning sports contracts entered from tribal lands. It sent the case back for the remaining preliminary-injunction analysis. That decision does not by itself establish a statewide California ban or blanket permission for every sports contract.

Check the exchange, the contract and any court restrictions that apply to your location.

Sweepstakes sports products

California's AB 831 added a prohibition covering defined online sweepstakes games that use a dual-currency system and award cash or cash equivalents. Its definition includes simulated sports wagering.

That is not a prohibition on every free game or ordinary occasional promotional drawing. Equally, calling a cash-prize product a sweepstakes does not establish a lawful substitute for a sportsbook. The actual statutory definition and product mechanics matter.

Can California residents bet in another state?

California residents may be eligible to place sports wagers while physically visiting a jurisdiction where the chosen sportsbook is authorized, provided they meet that jurisdiction's rules and the operator's requirements. A home address and the location of the wager are different facts. California's regulator expressly distinguishes complaints about licensed sportsbook wagers placed in another state.

Before traveling, check the destination's legal market, minimum age, account verification and location requirements. Use our US sports betting guide to find the relevant jurisdiction rather than assuming that every neighboring state has the same rules.

An account opened on a trip does not authorize sportsbook wagers after returning to California. The same applies if the app remains installed or allows access to account information. Neither circumstance changes California's prohibition on the covered wagering activity.

How to check a California sports betting claim

  1. Identify the exact service. Is it a traditional sportsbook, a horse-racing account, a fantasy contest or an event contract? Find the legal entity and product terms.
  2. Check the applicable authority. Read Penal Code section 337a and the relevant regulator information. A casino, racing or foreign licence does not automatically cover sports wagering in California.
  3. Verify a claimed change. Use the official qualified ballot list. Confirm approval and implementation separately before accepting a claim that betting has launched.

For complaints, the California Gambling Control Commission's guidance points to the Bureau of Gambling Control for illegal in-person sportsbooks and the FBI's Internet Crime Complaint Center for online sportsbook operations. It directs disputes concerning licensed bets placed elsewhere to that jurisdiction's gaming regulator.

For no-cost, confidential gambling support, California's Bureau of Gambling Control lists 1-800-GAMBLER and text SUPPORT to 53342.

California sports betting questions

No. Being 21 does not make a traditional sportsbook wager legal in California. Age is a condition applied to an otherwise authorized activity, not an exception to the state's sportsbook restrictions.

An overseas licence does not establish California authorization. The operator accepting your registration or payment does not resolve the state-law question, and California's regulator does not supply a licensed-market complaints process for such an operation.
