Are Sweepstakes Casinos Legal in California? Laws and Ban in 2026

No. Sweepstakes casinos using the dual-currency, cash-prize model defined by California law cannot legally be offered in California. Penal Code 337o took effect on January 1, 2026, following AB 831. It prohibits offering the specified online games and knowingly and willfully supporting their operation.

The California sweepstakes casino ban does not prohibit every prize draw or every game played with virtual coins. What matters is how the service works: the currencies, consideration, simulated gambling and redeemable prizes. This guide explains those distinctions, what free entry changes and where to report a problem.

What did California ban?

California's law defines an online sweepstakes game through four conditions that must all be present. These help explain why a casino can fall within the prohibition even when its website says the prize currency is free.

Online access

The game is available through the internet or accessible on a phone, computer or similar device. An app and a browser-based casino can both meet this condition; downloading software is not the deciding factor.

A dual-currency system

The system uses direct or indirect consideration and gives players eligibility for prizes. California's definitions address purchased coins and promotional credits, including free credits obtained through a related purchase or other promotion.

Simulated gambling

The game simulates gambling. The statute lists slots, video poker, table games, lotteries, bingo and sports wagering, among other examples. Calling the activity social entertainment does not change what the game actually does.

Cash or cash-equivalent prizes

The game awards cash or cash equivalents. The ability to redeem a prize currency is therefore a key distinction from a game that provides entertainment without cashing out the balance.

For example, a site may sell a nonredeemable currency and bundle it with another currency used in casino-style games for cash prizes. Describing the second currency as a free bonus does not remove it from the statutory analysis.

These are the conditions in Penal Code 337o. California also amended its rules on simulated gambling in prize promotions, so falling outside this particular definition does not establish that a different design is lawful.

Are ordinary sweepstakes and social casinos different?

Yes. A retail prize draw, a game without redeemable winnings and a cash-prize casino are different products. This comparison explains their features; it is not a list of approved operators.

ProductCalifornia distinction
Dual-currency cash-prize casino
Casino-style play combines direct or indirect consideration with redeemable prizes. Where all four conditions are met, section 337o prohibits offering the game. Neither a promotional label nor a free entry route supplies an automatic exception.
Occasional retail promotion
The statute preserves limited, occasional promotions incidental to substantial, genuine sales of consumer products or services. The exception does not cover a promotion intended to establish ongoing gambling. Other rules governing contests and consumer protection still apply.
Play without redeemable prizes
A game without cash or cash-equivalent awards lacks that feature of the defined model. Check whether points, tokens or rewards can actually be exchanged for value. The word social alone does not establish what the game offers.

California's companion provision, Business and Professions Code 17539.1, also addresses simulated gambling connected with sweepstakes prizes. A single-currency design is not automatically a workaround. Assess the actual purchase, play and redemption arrangement rather than relying on the number or names of coins displayed.

Does free entry make a sweepstakes casino legal?

No. Free entry does not, by itself, make a sweepstakes casino legal in California. Section 337o expressly includes certain freely obtained promotional coins within indirect consideration. A no-purchase-necessary statement cannot override a prohibition designed to address the wider arrangement, including the relationship between purchased coins, promotional credits and prizes.

That is different from saying every free prize draw is illegal. The law contains the limited exception for genuine, occasional retail promotions described above. A casino running continuously does not establish that exception simply by attaching prize entries to a coin package or offering a postal entry method. The substance and frequency of the activity matter more than the promotional wording. Our national sweepstakes casino guide explains why state rules differ.

Who does the law apply to?

Section 337o prohibits a person or entity from operating, conducting or offering the defined game in California. It also covers knowing and willful support by specified parties, including payment processors, financial institutions, platform providers, game suppliers and media affiliates. The provision is not limited to the company whose logo appears on the casino website.

Violating section 337o is a misdemeanor. Its wording focuses on operating, offering and supporting the prohibited activity; it should not be paraphrased as a new offence committed by every person who opens an account. Equally, this guide cannot promise that an individual faces no legal risk under any California law. Someone dealing with an investigation, demand or substantial disputed loss needs advice about their own facts.

What if a site still accepts California players?

A working registration form is not evidence of legal permission. Nor does a site become authorized because it accepts a California address, processes a payment or appears in an app store. Use the actual rules and keep a record of any problem.

  1. Identify the product. Read the purchase and prize rules for the exact service. Check whether one currency is purchased or bundled with another, what the games simulate and whether rewards can be redeemed. A familiar brand can operate more than one product.
  2. Preserve your records. Save the terms you used, transaction receipts, account balances, redemption requests and support messages. Include dates and the full website address. This is a practical evidence checklist, not a promise that a complaint will recover money.
  3. Ask about the existing balance. Contact the operator through its documented support channel for a written explanation of account closure or redemption decisions. Do not assume old withdrawal deadlines still apply, or spend more money merely because a message says it will unlock a withdrawal.
  4. Use the relevant reporting route. The California Gambling Control Commission's complaint guidance directs online-casino reports to the FBI's Internet Crime Complaint Center. For a consumer complaint about a business, the California Attorney General's form is another official route.

Reporting a suspected offence or deceptive practice does not guarantee an investigation, a refund or resolution of a private contract dispute.

California sweepstakes casino questions

When did California's sweepstakes casino ban take effect?

The prohibition in Penal Code 337o took effect on January 1, 2026. AB 831 added that section and changed related promotional-gaming rules. Older articles describing the bill as proposed or awaiting approval no longer describe its legislative status. An operator may have changed its service before that date, but its own closure or redemption timetable is a separate matter.

Do Chumba Casino, Stake.us or Global Poker have a different rule?

The statutory test concerns the product, not the brand name. A cash-prize service that meets the definition cannot avoid the California prohibition because it calls itself social gaming or uses a different name for its redeemable credits. Check the exact service rather than assuming that every product offered by a company works the same way. This guide does not verify these brands' current account access.

Does the ban decide which other gambling is legal in California?

No. The sweepstakes provisions do not settle the rules for every gambling product. Tribal casinos, cardrooms, the state lottery and other activities have their own legal frameworks. Permission for one does not authorize an online casino offering a similar game. See our California gambling laws overview for the broader distinctions and links to the relevant product guides.
