Is Gambling Legal in Delaware? Gambling Laws in 2026
Yes, gambling is legal in Delaware through authorized casinos, online casino and poker services, sports betting, Lottery products and horse wagering. Registered fantasy contests and permitted charitable games have separate rules. Approval for one product does not authorize everything a company offers.[1][2][3][4][5]

Casinos, racinos and video lottery
Casino gambling is legal at Delaware Park, Bally's Dover and Harrington under Delaware's Lottery framework. These racetrack casinos combine racing-related facilities with authorized casino gaming. The law uses terms such as video lottery for regulated machine games, separately from table games and ticket products.[6][2]
Casino play requires age 21. That rule should not be applied to every product carrying the Lottery name: ordinary tickets and internet ticket games have a different statutory minimum.[2]
Use the Delaware Lottery's casino directory to reach the current official channels. A similarly named site or a foreign license is not the same authorization.[1]
Are online casinos and poker legal in Delaware?
Yes, online casinos and online poker are legal and operating in Delaware through approved services. They are distinct from the newer iLottery ticket-game program.[1][7][12]
The practical requirements include age 21 and verified Delaware location. Limited statutory interstate provisions do not mean a Delaware account can be used from any state. Shared poker tables and permission to play from your present location are different questions.[1][2]

Is sports betting legal in Delaware?
Yes, sports betting is legal in Delaware through approved mobile and retail channels for adults aged 21 or older. The Lottery expanded its retail kiosk offering in summer 2026.[1][2][10]
The sports-lottery definition excludes events involving Delaware colleges or universities and amateur or professional Delaware teams.[2]

How old do you have to be to gamble in Delaware?
The Delaware gambling age depends on the product. Internet ticket games and internet casino games are different legal categories.

An adult may give a Lottery ticket to a minor under the statutory gift exception. That does not permit the minor to purchase tickets or open an online account.[2]
Can you buy Lottery tickets online in Delaware?
Yes, Delaware has an operating iLottery service, including eInstant ticket games. It launched on October 28, 2025; the Lottery's January 2026 announcement confirms the live eInstant program. This does not establish that every draw game is currently sold online.[6][12]
Section 4810 sets the statutory minimum for internet ticket games at 18. The official iLottery location policy requires physical Delaware presence for purchases. Check the current account terms as well: statutory age alone does not establish every registration or payment requirement.[2][20]
HB335 proposes changes to internet-ticket funding. Its official status shows committee progress on June 9, 2026, rather than enactment. It should not be mistaken for an effective new funding restriction or a shutdown of iLottery. Existing section 4826 already addresses prepaid cards and other Lottery-agent funding mechanisms.[2][21]
Start from the Lottery's iLottery announcement and its official service links, rather than an unrelated ticket-selling app.[12]
Horse betting and online account checks
Horse betting is legal in Delaware through the licensed track and regulated simulcast framework. Current racing Commission listings include 2026 reports. Delaware Park's venue rules set horse wagering at 18, separately from sports and slots at 21.[22][5][19]
That does not establish permission for every website offering Delaware horse accounts. General current online advance-deposit wagering authority and an approved-provider list were not verified for this guide. The proposed 2017 ADW bill did not establish an enacted permission in the recovered official record.[5][23]
Check the racing Commission about the specific channel. A child's permitted presence in a racing area is not permission to place a wager.[22][19]
Are home poker games legal in Delaware?
Home poker games are not automatically legal in Delaware simply because they are private or have no rake. The criminal provisions address betting activity, gambling devices and premises used for gambling. They do not supply a verified blanket home-poker exemption in this review.[15]
This does not establish that every friendly card game is criminal. The stakes, activity and applicable permission matter; privacy alone is not enough to resolve them.[15]
Licensed charitable Texas Hold'em is a separate, specific exception. Its requirements cannot be applied to an ordinary home game merely because both involve poker.[18]
Bingo, raffles and charitable poker
Delaware permits specified charitable gambling through qualified organizations and game-specific approvals. Use the Board of Charitable Gaming and DELPROS route before the relevant advertising, ticket sales or event, subject to applicable raffle exceptions.[4][24]
Ordinary bingo and charitable-game participation generally requires age 18. Assistance at 16 or waiting-table work at 14 is not permission to gamble. Charitable Texas Hold'em requires 21 even to be present.[17][18]
Limited charitable card-game permission is not a general casino-night license. Slots, roulette, craps and baccarat are excluded. Organization qualification, use of proceeds and the particular permitted game still matter.[17][14]
Raffles have limited exemptions and different permit routes. Check the Board's raffle guidance for your event rather than assuming every nonprofit raffle is exempt. Confirm the permit requirements with the Board before selling tickets.[17][24][25]
Are daily fantasy sports legal in Delaware?
Yes, daily fantasy sports are legal in Delaware through qualifying registered contests for players aged 18 and over. DGE lists Betr, DraftKings, FanDuel, PrizePicks, Underdog and Yahoo.[3][13]
The framework covers skill-based roster competition. Prizes must be established and disclosed in advance; winning outcomes predominantly use accumulated individual statistics reflecting player knowledge and skill. Outcomes cannot depend on the score, spread or performance of one actual team or a combination of teams, or solely one athlete's performance in one event.[13]
Delaware college/university events, high-school events and horse racing are excluded. Free contests and the specifically defined full-season pooled competition fall outside the chapter's contest definition; that is not blanket permission for every paid private league.[13]
Use the current fantasy register for the relevant product. Registration does not authorize the same company's sportsbook, casino or every pick-style game.[3][13]
Are sweepstakes casinos legal in Delaware?
A sweepstakes label does not make an unlicensed online casino legal in Delaware. The state has enforced its gambling laws against casino-style products presented as promotional sweepstakes.[16]
An April 7, 2025 announcement describes action against VGW Luckyland and reports that VGW Luckyland's platforms stopped Delaware participation effective April 2. This was agency enforcement under existing law, not a newly enacted 2026 sweepstakes statute.[16]

Are prediction markets legal in Delaware?
This guide cannot confirm that sports prediction markets such as Kalshi or Polymarket are lawful in Delaware. No current Delaware-specific primary ruling or agency determination was verified for this review.
That is not a finding that no action exists or that every event contract is prohibited. Platform availability and federal exchange status are different from permission under Delaware's sports framework.[2]
