Yes, gambling is legal in Idaho through specific tribal gaming, Lottery, horse wagering and charitable-gaming exceptions. Sports betting and unauthorized casino games or poker remain prohibited.[1][2][3][4]

Tribal casinos, video poker and live poker
Casinos are legal in Idaho within the tribal gaming framework. That does not create general permission for a commercial casino or an internet casino business.[3][7]
Is sports betting legal in Idaho?
No, sports betting is not legal through an Idaho-authorized sportsbook market. The Attorney General's March 23, 2026 statement describes the state's sports betting ban.[4]
An offshore website accepting an Idaho customer does not establish state permission. Sports prediction contracts raise a separate federal-versus-state dispute, discussed below; a different product label does not settle that dispute.[2][4][15]

Is online gambling legal in Idaho?
Some online gambling is legal in Idaho: licensed horse wagering accounts are permitted. Real-money online casinos and online poker do not have an authorized statewide market.[1][2][5][6]

How old do you have to be to gamble in Idaho?
The gambling age in Idaho depends on the activity. Lottery purchases and horse wagering require 18, while tribal venue policies and charitable-game rules need separate checks.[18][6][19]

The bingo rule distinguishes lower-value merchandise prizes from cash or merchandise over $25. It does not establish unrestricted access for every minor. A rule about minors working at bingo does not replace the separate rule about playing.[19][21]
Lottery tickets, apps and age rules
You cannot buy Idaho Lottery tickets online or by mail. The Lottery directs players to retailers in Idaho. An app for results or second-chance activity is not an online ticket shop.[10]
Ticket purchase and personal redemption require age 18. Separate prize-payment rules let the director pay an adult custodian for an entitled minor winner. That does not allow a minor to buy or personally redeem a ticket.[18][20][21]

Horse wagering and online accounts
Horse betting is legal in Idaho through licensed pari-mutuel channels, including authorized telephone and electronic accounts. In pari-mutuel wagering, bets are pooled rather than offered as ordinary sportsbook bets.[5][6]
An advance-deposit wagering account, often called ADW, lets an eligible customer fund an account and place horse wagers remotely. Idaho requires licensing for the out-of-state provider and age verification for account holders. Customers must be at least 18.[5][6]
Start with the Idaho Racing Commission, which lists ADW providers, simulcast information and a race schedule. Check the approved provider before depositing and the current schedule before travelling to a race. Permission to conduct racing does not mean meetings run every day.[17]

Is home poker legal in Idaho?
Real-money home poker has no general exemption under Idaho gambling law. Playing in a private home or taking no rake does not by itself make the game lawful. The statute covers participation and knowingly permitting unlawful gambling on property under someone's control.[2][13]
Poker's skill element is not a general escape from the prohibition. In its July 22, 2015 decision, the Ninth Circuit affirmed a preliminary injunction against Coeur d'Alene's Texas Hold'em offering. The court rejected reliance on the skill-contest exception and explained that uneven enforcement does not create legal permission.[8]
Free play without anything of value at stake is different from wagering money or property. Alcohol Beverage Control guidance addresses games at licensed establishments; it should not be treated as a separate private-home exception.[2][24]
Bingo, raffles and charity fundraising
Charitable bingo and raffles are legal in Idaho when the organization and game meet the applicable rules. Calling an event a fundraiser does not authorize every gambling format.[11][12]
The Lottery expressly rejects casino nights, poker runs and Calcuttas as substitutes for the authorized charitable games. Giving the proceeds to a good cause does not remove those restrictions.[11]
Some qualifying activities are exempt from licensing, but they still have operating requirements. Check the licensed organization directory and ask the Lottery about any claimed exemption. Absence from the directory alone is not proof an exempt event is unlawful.[12][21][25]
For bingo, people under 18 cannot participate in games offering cash or merchandise worth more than $25. Current rules allowing minors to work under house rules concern workers, not permission for them to play those games.[19][21]
Raffles require a separate eligibility check. Use the Lottery's charitable-gaming guidance and contact for a particular event rather than borrowing a casino or Lottery-ticket age rule.[22]
Are daily fantasy sports legal in Idaho?
Paid daily fantasy sports face restrictions in Idaho. The Attorney General's 2016 report records agreements under which DraftKings and FanDuel stopped paid daily fantasy contests in the state.[14]
Those agreements concerned the two operators' paid contests, not every free fantasy league. The report described possible resumption after legislative change; it did not itself authorize a restart. No later Idaho DFS licensing framework was verified for this guide.[14]
Sweepstakes casinos and prediction markets
Sweepstakes casinos
Sweepstakes casinos are not automatically legal in Idaho because they offer free coins. The constitutional and statutory exceptions for genuine no-consideration promotions concern qualifying promotions incidental to a nongaming business. Purchase requirements and indirect consideration can change the analysis.[1][2][11]

Prediction markets
The legal status of sports prediction markets such as Kalshi is disputed in Idaho. Idaho's Attorney General supported state authority in Nevada litigation in March 2026. The CFTC asserted exclusive federal jurisdiction in a February 2026 filing announcement.[4][15]
These are agency positions, not a final Idaho ruling that every contract is permitted or prohibited. They do not establish a state sportsbook licence, and this guide does not confirm the latest order governing a particular platform.[4][15]
