Is Gambling Legal in Kansas? Gambling Laws in 2026

Yes, gambling is legal in Kansas through authorized casino, tribal, sports, Lottery, horse wagering and charitable-gaming channels. Qualifying fantasy leagues also have a statutory exception.[1]

State casinos and tribal gaming

Casinos are legal in Kansas under distinct state and tribal frameworks. The Kansas Racing and Gaming Commission, or KRGC, lists Boot Hill, Kansas Star, Hollywood and Kansas Crossing as its four certified lottery gaming facility managers.[5]

State casino gaming

Kansas uses privately managed facilities for state lottery casino gaming. State ownership of the games does not mean the government owns every casino building. Use the certified manager directory to check the facility.[19][5]

Tribal gaming

Tribal gaming involves tribal regulation, federal law and compacts for Class III games. The State Gaming Agency directory lists Class III casino and commission contacts; it is not a count of every tribal gaming property or proof of statewide internet casino permission.[7][8]

Tribal eligibility also depends on the game and property. Prairie Band's on-property sportsbook requires 21; Golden Eagle's bingo rules require 18.[21][22]

Is sports betting legal in Kansas?

Yes, sports betting is legal in Kansas through authorized retail and mobile channels for people aged 21 and older. Mobile bettors must be physically in Kansas when wagering.[6][23][2]

That location rule matters around Kansas City: being on the Missouri side does not satisfy Kansas's mobile wagering condition. A Kansas address alone is insufficient if you are elsewhere when placing the bet.[2]

The Kansas Lottery reports a September 2022 launch. Its August 2026 report records both retail and online wagering, confirming activity rather than a market waiting to open. That report does not guarantee future operator contracts or renewals.[9][24]

Use the official Lottery sports page for its authorized casino sportsbook channels. Prairie Band separately describes an on-property tribal sportsbook, which should not be mistaken for statewide tribal mobile betting.[21][9]

Is online gambling legal in Kansas?

Some online gambling is legal in Kansas: authorized mobile sports betting and official online Lottery games operate. Kansas does not have a state-regulated online casino or poker market.[2][3][10]

Authorized online products

Approved sportsbooks and the Lottery's PlayOn service have separate product, age and location requirements. PlayOn eInstant games remain Lottery products even when their screen presentation resembles casino games.[6][2][10][11]

Casino and poker websites

An overseas licence or successful registration does not establish Kansas authorization. The regulator distinguishes operating i-lottery from absent i-gaming; one online channel does not authorize the other.[1][16][3]

How old do you have to be to gamble in Kansas?

The gambling age in Kansas is 21 for state casino games, sports betting and pari-mutuel ticket purchases. Lottery purchases and PlayOn accounts require 18. Tribal and charitable games need separate checks.[6][11][12][14]

A casino privacy policy or a worker's minimum age is not permission to wager. Check the actual game's participation rule.[6][17]

Kansas Lottery tickets and online games

You can buy official Kansas Lottery games online through PlayOn Kansas. The government Lottery website links to the service, which offers eInstant and draw games.[10][4]

PlayOn's terms, updated June 25, 2026, require:

  • An account holder aged 18 or older.
  • Residence in the United States or a US territory.
  • Physical presence in Kansas when adding funds and purchasing.[11]

Kansas residency and physical location are different requirements. The terms do not restrict accounts to Kansas residents, but a player outside Kansas cannot satisfy the location condition merely by having a Kansas home address.[11]

Retail ticket sales also remain subject to age restrictions. Retail sales rules should not be mistaken for proof that the Lottery's own verified online service is unavailable.[3][12]

Horse wagering and historical racing

Horse wagering is legal in Kansas through regulated pari-mutuel channels. Buying pari-mutuel tickets requires 21 under the current statute.[13][14]

Existing wagering activity

KRGC's March 2026 packet records Gilley's simulcast and historical horse racing activity. Kansas horse wagering is not simply waiting for every live racetrack to reopen.[3]

Historical horse racing

HHR uses previously run races. Kansas permits approved machines at licensed premises in Sedgwick County and expressly prohibits HHR wagering through internet websites or mobile networks. These are not ordinary casino slots or an authorized remote casino app.[15]

Remote horse accounts

General interstate online horse-account permission was not established for this guide. The HHR internet ban is specific; it does not resolve every other horse product. Ask KRGC about the particular facility or channel before using it.[13][15][14]

As checked October 3, Eureka Downs' first race day is scheduled for October 17, 2026. That is a future date, not a completed reopening.[13]

Is home poker legal in Kansas?

Real-money home poker has no blanket exemption under Kansas gambling law. A private address, social purpose, small stakes or no rake does not by itself establish permission.[1][16]

Indirect consideration matters too. KRGC identifies cover charges, chair rental and increased business from supposedly free chips as potential gambling considerations. Calling play free does not remove those arrangements.[19]

A game without a bet is a different question from wagering money or value. Do not treat that distinction as permission to disguise paid poker.[1][16]

Bingo, raffles and charity fundraising

Charitable bingo and raffles are legal in Kansas when eligible organizations meet the applicable rules. Charitable purpose alone does not legalize casino or poker nights.[19][17][18]

For charitable call bingo, KDOR says there is no statutory minimum player age, although house restrictions may apply. Buying instant bingo tickets requires 18. Bingo-worker rules are separate from player eligibility.[17]

Eligible nonprofit organizations with no more than $25,000 in annual raffle gross receipts during the July-June year are exempt from raffle licensing. That exemption does not authorize an individual's fundraiser or remove other operating conditions.[18]

Online raffle-ticket sales are permitted subject to the other requirements. This differs from prohibited electronic raffle machines. KDOR also prohibits using professional raffle vendors.[17][18]

Use KDOR's bingo FAQ and raffle guidance to check the organization, game and licence or exemption before selling tickets.[17][18]

Are daily fantasy sports legal in Kansas?

Fantasy sports are legal in Kansas when the league meets the statutory exception. The conditions include all of the following:[1]

  • No fantasy team may be based on an actual team's current membership. Prizes must be established and disclosed beforehand, with values independent of entrant numbers or fees.
  • Winning outcomes must reflect relative knowledge and skill, predominantly through accumulated individual-athlete statistics.
  • Outcomes cannot depend on an actual team's score, spread or performance, or combinations of teams; nor solely on one athlete's performance in a single event.[1]

A pick'em label alone does not establish compliance. Check the actual format; the exception does not approve every product described as fantasy.[1]

Sweepstakes casinos and prediction markets

Sweepstakes casinos

Sweepstakes casinos are not automatically legal in Kansas because they offer free coins. Consideration can be indirect, and KRGC's guidance specifically addresses illegal sweepstakes and phone-card machines.[1][19]

Prediction markets

Kansas sportsbook permission does not automatically cover prediction markets such as Kalshi. The state's sports definition includes exchange wagering within its authorized framework, but that wording does not prove a federally registered event-contract platform has Kansas approval.[20]

No Kansas-specific court order settling a particular platform's current statewide status was verified for this guide. Treat the question separately from the established retail and mobile sportsbook market.
