Is Gambling Legal in Maine? Gambling Laws in 2026

Yes, gambling is legal in Maine through regulated casinos, sports betting, Lottery, horse wagering, fantasy and qualifying charitable games. Internet casino gaming and poker have been authorized, but regulated online casino and poker play has not launched as of October 3, 2026.[1][2][3]

Casinos and live poker

Casino gambling is legal at Maine's licensed commercial casinos, Oxford and Hollywood Bangor. Hollywood advertises slots, table games and a live poker room. These are operating physical venues, unlike the internet casino market awaiting implementation.[1][3][5]

Casino play requires age 21. The exception allowing certain licensed employees aged 18 to 20 into gaming areas is not permission for them to gamble.[4]

Tribal control of eligible mobile sports and internet-gaming licenses does not make Oxford and Hollywood tribal casinos. Check the Gambling Control Unit directory for the actual product and venue.[1][2][6]

Is online gambling legal in Maine?

Some online gambling is legal in Maine, including licensed sports, fantasy and horse-wagering channels and qualifying internet raffles. Online casino gaming and poker are authorized in law, but their regulated market has not launched.[1][2][3][14][24][16]

Law enacted

Chapter 538 became law without the Governor's signature on January 11, 2026. It includes approved casino games and poker, with operator licenses reserved to qualifying Maine tribes and the specified tribal-owned entities.[2]

Rules still proposed

GCU published its third internet-gaming rules proposal on September 30, 2026, with comments due October 30. A proposal is not a final rule or a launch announcement.[25]

Applications not accepted yet

As checked October 3, forms can be prepared, but GCU says applications are not being accepted. An announced partnership or downloadable form is not an issued operator license.[3]

Is sports betting legal in Maine?

Yes, sports betting is legal in Maine through licensed mobile and retail channels. GCU currently links DraftKings and Caesars for mobile play. Official August 2026 reports also document retail wagering at First Tracks/Oddfellahs and Oxford.[1][8][26][9][10]

Mobile sports operator licenses are reserved to eligible Maine tribes. Bettors must be at least 21 and physically in Maine; the same brand's casino or fantasy products need their own authority.[6][7]

Maine college-team events are excluded wherever played. In a tournament involving a Maine team, bets may be accepted on games without a Maine team. This does not permit betting on the Maine team's individual games. High-school events and events primarily involving under-18 participants are also excluded.[11]

How old do you have to be to gamble in Maine?

The gambling age in Maine varies by product. Purchase, participation and employment rules are different.

Internet raffle buyers must be 18. Hollywood's racing terms allow wagering at 18, separately from its casino age.[29][24]

Lottery tickets and online purchase

Maine Lottery tickets are sold through retail channels, not through an official online ticket-sales service. The Lottery's February 2026 FAQ expressly says tickets cannot be purchased online. An app's electronic playslip still needs to be scanned at a retailer.[12]

You must be 18 to buy tickets. Nonresidents may purchase while physically in Maine. An adult may buy a ticket as a gift for a minor, subject to the statute's separate promotion limits; the purchase rule is not a blanket possession ban.[12][13]

Third-party courier approval has not been verified for this guide. Check the official Lottery guidance before treating an app as a ticket seller.[12]

Horse betting, residency and online accounts

Horse betting is legal in Maine through approved racing and wagering channels. The commission publishes a current harness-racing calendar, and Hollywood Bangor offers live and simulcast wagering. Scheduled dates should be checked before travelling.[30][15]

Online horse wagering uses a separate advance-deposit wagering, or ADW, framework:

Horse account: residency matters

To establish a Maine ADW account, you must be at least 18 and a Maine resident. Visiting the state is not equivalent to satisfying this account requirement.[14]

Mobile sports: location matters

Mobile sports betting requires physical Maine presence and age 21. Do not transfer that eligibility test to a horse-wagering account.[6][7]

Are home poker games legal in Maine?

Home poker games can qualify as social gambling in Maine, but a private address or no-rake arrangement alone is insufficient. A license is not required when a game constitutes social gambling under the statutory definition.[21][20]

The conditions include:

  • Participants play on equal terms and are entitled only to their personal winnings.[21]
  • No person or organization profits directly or indirectly from fees, facilitating play or providing premises.[21]
  • Profitable refreshments, food, drink or entertainment cannot supply an indirect commercial benefit from the gambling.[21]

Ordinary player winnings are different from organizing profit. A bar promotion or paid poker club cannot assume it qualifies simply because the organizer does not take a share of each pot.[21]

Bingo, raffles and charity game nights

Maine permits specified charitable games, including qualifying game nights, under game-specific rules. Eligible organizations may need licenses or registration, an established local presence and municipal approval. Card games, tournaments and an annual game night have distinct provisions.[19][20]

Ordinary raffle exemptions do not extend automatically to internet raffles. An online raffle needs a licensed operator acting for an eligible registered organization and an approved system. Consumer conditions include being 18 and physically in Maine, using a funded raffle account, and no credit-card purchase or operator credit.[31][24]

Ordinary beano participation requires age 16. Younger children may be present with a responsible adult, which is different from playing. Specified campground, resort and K-8 school games can allow under-16 participation under their own conditions; the senior-organization exemption is not that age exception.[27][28]

Check the GCU charitable-gaming route for the exact event. Raising money for charity alone does not supply permission, and an applicant's age is not automatically every player's minimum.[19][20]

Are daily fantasy sports legal in Maine?

Yes, daily fantasy sports are legal in Maine through licensed qualifying contests for adults aged 18 and over. GCU lists DraftKings, FanDuel, RealTime, PrizePicks and Dabble for fantasy.[16][17]

The definition requires at least two paying contestants, excluding the operator, competing through skill and simulated-roster management. Outcomes predominantly use accumulated individual statistics, without depending on one participant or one sports-event outcome.[18]

Additional rules require advance public notice of prizes. Outcomes cannot be based on a single team or combination of teams, or solely one individual's performance in one event. High-school and under-18 athlete restrictions also apply.[17]

A listed brand does not make every pick-style, casino or sports product it offers permissible. Check its exact contest against the GCU fantasy information.[16][17][18]

Are sweepstakes casinos legal in Maine?

Maine prohibits the defined online sweepstakes casino model. Chapter 645 was approved April 6, 2026, and GCU confirms that the prohibition took effect July 29, 2026.[22][23]

The definition combines internet access, a dual-currency payment system and simulated casino-style gaming. It includes direct and indirect consideration, so describing coins as promotional or offering free entry does not by itself establish an exemption.[22]

The express prohibition concerns operating, promoting or supporting the defined games. That is different from saying every free promotional game is banned or that ordinary participation alone is the expressly prohibited conduct.[22]

Are prediction markets legal in Maine?

This guide cannot confirm that sports prediction markets such as Kalshi or Polymarket are lawful in Maine. No current Maine-specific primary ruling or agency determination was verified for this review.

That gap does not establish a statewide ban or prove that no action exists. Federal exchange status and app availability are different from a Maine sports-wagering license. Maine's general gambling definitions alone do not settle a federal preemption dispute.[21]

Check the specific product's authority and any current operative order before treating event contracts as an approved substitute for a licensed sportsbook.
