Is Gambling Legal in Massachusetts? MA Laws in 2026

Yes, gambling is legal in Massachusetts through specified casino, sports, horse-wagering, Lottery and fantasy channels. Tribal gaming and qualifying charitable events have their own rules. This does not authorize every gambling website accessible in the state.[1][2][3][4]

Casinos, slots and First Light tribal gaming

Casino gambling is legal at licensed Massachusetts venues, with different permissions for resort casinos, slots and tribal gaming. A casino's proposed expansion does not establish its current game menu.[5][7][2]

Commercial properties

Encore Boston Harbor in Everett and MGM Springfield hold Category 1 casino licences. Plainridge Park in Plainville is the Category 2 slots facility. These casino categories differ from similarly numbered sports-wagering categories.[5][6][8]

First Light tribal gaming

The Mashpee Wampanoag Tribe's First Light gaming floor in East Taunton is open. The full Class III resort, including live blackjack, poker and roulette, is advertised as coming soon. Entry to the current gaming floor requires 21 and valid ID.[7][21]

Use the MGC directory and First Light's current site for the particular venue.[5][7]

Is online gambling legal in Massachusetts?

Yes, some online gambling is legal in Massachusetts: licensed sports wagering, qualifying fantasy contests, authorized horse wagering and Mass Lottery Online. Ordinary internet casinos and cash-poker sites do not gain approval from those permissions.[1][3]

The state's joint consumer advisory identifies casino gambling as unavailable online. A sportsbook licence does not authorize online slots, roulette or blackjack under the same brand.[1]

Internet-gaming bill H.4431 went to study order H.5269 on March 23, 2026. That step was not enactment or a market launch, and does not support a promised legalization date.[22]

Is sports betting legal in Massachusetts?

Yes, sports betting is legal in Massachusetts through licensed retail and online sportsbooks for people aged 21 or older. The MGC's current list separates the two channels.[8][9]

Licensed mobile wagers must come from people physically in Massachusetts. Credit cards cannot fund sports wagers. Check the exact business and platform in the official sports-wagering list; another state's licence is insufficient.[8][9]

Betting involving a Massachusetts college team is restricted unless the team is involved in a qualifying collegiate tournament. Individual college-athlete proposition bets are prohibited. The tournament exception does not remove that individual-performance restriction.[23][24]

The location of a tournament and whether a Massachusetts team participates are different questions. Use the MGC sports FAQ for the event rather than assuming all college betting is allowed or banned.[23]

How old do you have to be to gamble in Massachusetts?

Massachusetts uses different gambling ages for different products. Online Lottery play requires 21 even though retail purchases and Player Account registration start at 18.[10][25]

Mass Lottery Online and retail tickets

You can buy and play Massachusetts Lottery games online through the official service. Mass Lottery Online launched on July 27, 2026 through the app and website. Subsequent official reporting describes actual eInstant winners.[3][26]

Online deposits, purchases and play require physical Massachusetts presence and enabled location services. You do not need to be a Massachusetts resident. Online play requires 21; retail purchases remain available at 18.[10][27]

A Player Account can be registered at 18, but that does not authorize its holder to play online before 21. Scanning tickets, claiming prizes and online wagering are different functions.[26][25]

The current Mega Millions page also identifies online purchase availability. That does not establish that every retail game or third-party courier is available or approved.[28]

Horse racing and online wagering

Horse betting is legal in Massachusetts through authorized channels, including online wagering at 18 or older. The state's joint advisory expressly identifies that online permission.[1]

The MGC racing division identifies harness racing at Plainridge and says there are no active live thoroughbred tracks. The absence of live thoroughbred racing does not mean simulcast or authorized account wagering is unavailable.[11]

Use the MGC horse-racing division and its licensing/contact route to check the provider. An app accepting a customer is not proof that the particular provider and product are authorized.[11]

Are home poker games legal in Massachusetts?

A private address and no house rake do not automatically make home poker legal in Massachusetts. Different gambling provisions address players, public places and betting businesses.[13][14][29]

  • Section 271:1 concerns winning and receiving at least $5 at one sitting, subject to statutory qualifications. It is not a permitted $5 stake limit.[13]
  • Section 271:2 addresses specified public places and private places where a player trespasses. That narrow scope does not create a general private-game exemption.[14]
  • Section 271:17 covers specified betting/pool businesses and associated conduct. It does not automatically make every friendly participant a felon.[29]

The setup matters, including stakes, payments and the organizer's role. Do not treat a club's no-rake description as a legal clearance.

Bingo, raffles and charity casino nights

Qualifying Massachusetts nonprofits can run permitted raffles and bazaars, including casino nights and poker tournaments. The organization must have been organized and active in Massachusetts for at least two years; municipal permits apply.[4]

Bazaars are limited to three per calendar year, five hours per event and no more than one per day. The three-event cap applies to bazaars, not all raffles.[4]

Beano has separate rules. Under-18s cannot enter the portion of the premises used for Beano during the occasion. This is not a universal age rule for every charitable fundraiser.[12]

The Attorney General's guidance flags legal complications for online raffles and recommends review of the particular event. It does not establish a simple rule banning every internet raffle sale.[4]

Use the official nonprofit gaming FAQ and the city or town's permit process. Charity status alone does not authorize every gambling format.[4]

Are daily fantasy sports legal in Massachusetts?

Yes, qualifying daily fantasy sports are legal in Massachusetts under the enacted framework and Attorney General rules. Covered commercial contests require age 21.[15][16]

Prizes must be established and disclosed in advance. Outcomes must reflect relative knowledge and skill, predominantly accumulated individual statistics. They cannot depend on an actual team's score, spread or performance, or combinations of teams; nor solely on one individual's performance in one event.[16]

Current operator rules exclude amateur, college, high-school and student sporting events. Exempt free/private contests have separate scope.[15]

Use the official fantasy directory for the operator, while checking the particular product. Inclusion does not approve every branded offering. The July 2026 updated rules were proposed for comment, not proof of adoption.[30][31]

Are sweepstakes casinos legal in Massachusetts?

A free-entry option or dual currency does not establish that a sweepstakes casino is legal in Massachusetts. The rules examine payment for a chance to win and whether gambling predominates over a genuine sale.[18]

The sweepstakes-device provision depends on its statutory definition and possession by a sponsor or promoter. It also preserves lawful-activity exceptions.[17]

Are prediction markets legal in Massachusetts?

Sports prediction contracts have been contested in Massachusetts separately from licensed sports betting. A prediction platform is not automatically an MGC-licensed sportsbook.[1][19]

The Attorney General announced preliminary relief against Kalshi in January 2026. A court-hosted Commonwealth filing recounts the formal February 6 injunction and a February 17 appellate stay pending further order, with no view expressed on the merits.[19][20]

Preliminary relief and an appellate stay are procedural steps, not a final legality ruling. The filing quotes the stay, and an SEC issuer disclosure corroborates the history, but neither is a complete current court docket.[20][32]

These sources do not establish the litigation's final outcome or that the stay remains operative today. They also do not settle every platform or contract category. Check later court developments before relying on a definitive current availability claim.
