Yes, gambling is legal in Montana in specifically authorized forms, including licensed video games, permitted live poker, the Lottery, location-limited sports betting, approved horse wagering and qualifying fantasy leagues. Tribal casinos operate under a separate framework.[1][2][3][4][5][6][7]

Montana gambling laws make the location and channel important. An app may let you prepare a sports bet at home while requiring you to visit an authorized outlet to place it.[5]

Montana casinos and video gambling machines

Montana's state-licensed gambling premises often offer video games rather than the full range of games associated with a destination casino. The approved machine categories include bingo, poker, keno, video line and multigame machines.[2]

Video gambling

Approved machines need the relevant operator, premises and machine permissions. A liquor license alone does not authorize gambling.[2][8]

Live card games

Poker is an authorized card game, but public tables have their own licensing and permit requirements. This does not authorize every house-banked casino game.[1][3][9]

For the state-regulated premises covered by these rules, the limit is 20 machines. Video wagers are capped at $2 per game, with a maximum $800 award in free games or credits, redeemable through a voucher.[8][21]

Alcohol-license qualifications and specified exceptions also matter. These state limits should not be applied automatically to tribal casinos.[8][22][4]

Tribal casinos and the 2026 compact

Tribal casino gaming has its own federal, tribal and compact framework. Check the particular tribe and venue instead of treating a state bar's machine permit as the relevant authority.[4]

The Confederated Salish and Kootenai Tribes compact took effect January 26, 2026 after the federal review period expired without action. Approval applies only to the extent consistent with the Indian Gaming Regulatory Act.[10]

The updated state overview describes sports-wagering authority on the reservation. That establishes permission, not proof that a particular sportsbook has launched. The Indian-land exception also does not create unrestricted statewide tribal mobile gambling.[1][4]

Gray Wolf Peak is an operating tribal casino whose rules prohibit gaming by under-18s. That is a venue-specific example, not a universal age or game inventory for every Montana tribal property.[23][24]

Is online gambling legal in Montana?

Some online gambling is legal in Montana through specific exceptions, including licensed horse-wagering accounts. There is no general statewide authorization for internet casino games or online poker under the framework reviewed.[1][6]

The internet-gambling definition also contains exceptions for the Lottery, qualifying registered nonprofit raffles and qualifying gaming on Indian lands. Each has its own limits; an exception is not permission for every gambling website.[1]

In particular, Sports Bet Montana's app requires an authorized location when placing a wager. Licensed Lottery couriers are a separate ticket-purchase route, and online fantasy wagering is prohibited.[5][12][7]

A website accepting your address or an offshore license does not establish Montana authorization. The legal question concerns the actual game, provider and channel.[1][25]

Is sports betting legal in Montana?

Yes, sports betting is legal in Montana through Sports Bet Montana at authorized locations. Players must be 18 or older. Its mobile interface does not permit betting from anywhere in the state.[5][11]

At home

You can register, manage your account, review information and prepare bets. You cannot place the wager from home.[5]

At an authorized outlet

You can place a wager using the terminal or Sports Bet Montana app at the permitted location.[5][11]

Use the official sales-agent finder and select the Sports Bet Montana filter. An ordinary Lottery retailer is not necessarily a sports-wagering outlet.[11]

Do not assume a national DraftKings or FanDuel account replaces this local permission. The relevant question is whether the particular wagering service is authorized for that location and product.[1][5]

How old do you have to be to gamble in Montana?

The usual minimum gambling age in Montana is 18, with a narrow raffle exception and venue-specific rules.[26]

The raffle exception permits eligible minors to buy or sell tickets and receive prizes under its conditions. It does not extend to sports wagers, machines or every charitable event.[26]

Can you buy Montana Lottery tickets online?

You can obtain Montana Lottery tickets through licensed couriers, although the Lottery does not sell tickets directly over the internet. Its official FAQ names Jackpocket, Mido Lotto and TuLotero as licensed courier sales agents.[12]

Lottery ticket purchasers must be at least 18. Check the Lottery FAQ and the courier's own terms before using an app; the courier route is different from direct state internet sales.[12]

The Lottery app's scanning and player-service features do not establish an online casino or internet instant-ticket market.[12]

Is online horse betting legal in Montana?

Yes, online horse betting is legal through a Board-licensed advance deposit wagering hub. Montana law requires an eligible account, age 18, identity and residence verification, and sufficient deposited funds.[6]

Check the provider against the Board of Horse Racing's authorized ADW list. The Board warns about companies taking Montana wagers without appearing on that list.[13]

Account residence verification is not, by itself, a rule that every customer must be a Montana resident. Nor does legal authority for live racing establish that a particular meet is operating; check any track's current calendar separately.[6][13]

Is poker legal in Montana, including home games?

Yes, live poker is legal in Montana through the authorized card-game framework. Public tables generally need the appropriate operator license, premises qualifications and table permit, subject to specific exceptions. Internet poker is a separate question.[3][9][1]

Home poker requires a closer look. The general prohibition concerns public gambling, which can include a private place where players are publicly recruited or the activity is predominantly commercial. It is not a categorical ban on every genuinely private, noncommercial game.[1][25]

However, a home address or absence of rake does not establish a blanket exemption. Poker is not in the named minimal-prize social-card exclusion, and illegal devices or house-banked games raise separate issues. Check the arrangement before organizing paid play.[1]

Bingo, keno and raffle rules

Bingo and keno are not restricted to charity in Montana. The normal live-game permit applies to specified premises. Qualifying charitable organizations can receive particular tax or permit-fee relief, but must still apply and meet the remaining requirements.[16][17]

Raffles have separate prize, ownership, geographic and proceeds rules. Qualifying registered nonprofits can sell tickets online under the applicable conditions, with out-of-state purchases limited to jurisdictions where the purchase is not prohibited. This is not an internet-sales exception for every organizer.[1][15]

The minor-participation exception applies to compliant raffles supporting the specified charitable, scholarship, educational or community-service purposes. It should not be treated as a complete test for how the organizer may use proceeds.[26][15]

Check the raffle statute and Gambling Control Division before advertising. A permitted payment method, institutional prize exception or charitable purpose does not automatically authorize every casino-style fundraiser.[15][27]

Are daily fantasy sports legal in Montana?

Paid online daily fantasy sports are not permitted under Montana's fantasy-league law. Qualifying fantasy leagues are allowed, but wagering by internet or telephone is prohibited.[7]

The full fantasy definition includes conditions such as limited membership, entrance fees, fictitious professional-athlete teams and written league rules. Those are examples, not the complete test; selection, roster, transaction and payout rules also apply.[14]

A PrizePicks, Underdog or other brand's availability does not answer whether the precise contest and wagering channel meet Montana law. The separately regulated pari-mutuel fantasy format also requires physical participation rather than remote telephone or internet wagers.[6][7]

Are sweepstakes casinos legal in Montana?

Montana's internet-casino prohibition reaches online casinos taking wagers and making payouts using any form of currency. A dual-currency sweepstakes label or offshore address does not create an automatic exception.[1][18]

SB555 became chapter 626 after approval on May 12, 2025. It took effect October 1, 2025 under the state's default effective-date rule, and the amended definition is in the current code.[18][28][1]

The definition separately excludes online casinos that allow no currency of any kind. That wording should not be expanded into a ban on every ordinary free promotion. The added felony provision concerns operating an illegal internet gambling enterprise, not an automatic operator-felony charge for every player.[1][18]

Are prediction markets legal in Montana?

Montana's Kalshi proceedings do not establish that every prediction market is lawful. A September 17, 2026 stipulation set conditional limits on enforcement against Kalshi and specified related parties over its designated-contract-market event contracts.[19]

The agreement tied enforcement timing to further-review and en-banc developments in the identified Ninth Circuit proceedings, followed by a 30-day written-notice requirement. It was not a permanent promise against enforcement or permission for every platform.[19]

On September 21, the court dismissed five commission defendants with prejudice and the Attorney General, Sterhan and Gambling Control Division without prejudice. That procedural order did not decide the underlying products' legality.[20]

These are dated events, not confirmation that every condition remains unchanged today. For Kalshi, Polymarket or another service, check the current applicable order and product scope. The agreement did not repeal Montana's internet-casino law.[19][20]
