Is Gambling Legal in Nebraska? Gambling Laws in 2026
Yes, gambling is legal in Nebraska through specific authorized channels, including licensed racetrack casinos, retail sports betting, pari-mutuel racing, the Lottery and regulated charitable games. Tribal gaming follows a separate framework.[1][2][3][4]
Nebraska gambling laws do not currently authorize statewide mobile sports betting. The November 3, 2026 ballot measures are proposals, not permission to launch or use an online sportsbook today.[2][5]

Are casinos legal in Nebraska?
Yes, casinos are legal in Nebraska through the licensed racetrack framework, alongside separately governed tribal venues. A racetrack casino's permission is tied to its licensed enclosure.[1][7][3]
A statutory category does not tell you whether a particular property currently offers poker or another game. Use the regulator's gaming facilities page and licensing contact to confirm the intended venue and offering.[20][21]
Casino slots, keno and approved cash devices
These products can look similar but have different permissions and ages.[1][22][15]
Check DOR's approved-device hub and current notices. The agency flags court restrictions on enforcement of two regulation subsections, so an older rule list may be incomplete.[14]
Is online gambling legal in Nebraska?
Nebraska does not authorize statewide online casino, internet poker or mobile sports betting through its racetrack gambling framework. Casino and sports permission is tied to licensed physical locations.[1][2][7]
Remote horse accounts and Lottery couriers require separate checks; their status cannot be decided by an offshore site's willingness to accept a customer. The confirmed channels are explained below.[9][23][24]

Is sports betting legal in Nebraska?
Yes, sports betting is legal in Nebraska in person at approved racetrack sportsbook windows or kiosks. Players must be 21. Mobile and online sports betting are not currently authorized.[2][25]
Restrictions include:
- Collegiate events held in Nebraska involving a Nebraska college or university team are excluded.[7]
- Individual-athlete props and in-game wagers are excluded when a Nebraska collegiate team participates.[7]
- Minor-league and high-school-or-lower events are excluded; under-18 professional or international athlete props are also restricted.[7]

Initiatives 440 and 441 on the November 3, 2026 ballot propose online sports authority and its regulatory framework. They are not current permission, a guaranteed launch date or approval of online casino games.[5]

How old do you have to be to gamble in Nebraska?
Nebraska has several gambling ages. The tribal example below is a property rule, not a statewide tribal minimum.[1][3][9][11]

Permission for a minor to play a particular bingo event does not allow that minor to conduct it.[26]
Can you buy Nebraska Lottery tickets online?
An “online game” in Nebraska's Lottery law means a retailer-terminal game connected to the central system. It does not establish consumer internet ticket sales.[24]
Use authorized Lottery retailers and check the Lottery's current retailer guidance. Players must be 19 to purchase or redeem tickets, and tickets cannot be purchased for someone under 19.[11][12]
Lottery vending machines were authorized from July 18, 2026. That authorization is different from proof that a machine has been installed or that a courier is approved. Confirm a proposed remote ordering service directly before relying on it; this guide does not establish general courier permission.[22][24]
Is horse betting legal in Nebraska?
Yes, horse betting is legal in Nebraska through licensed pari-mutuel racing and authorized simulcasts. Current law requires bettors to be 21 and present within the licensed enclosure receiving the wager.[9][10]
The regulator publishes live racing dates. Confirm the track's current schedule and available simulcasts before visiting.[28]
Online horse wagering needs particular care. A 2002 Nebraska Supreme Court decision invalidated the challenged telephone-wagering framework because betting instructions had to originate within the licensed enclosure. That historical judgment does not, by itself, resolve every current out-of-state advance-deposit account.[23]
Ask the Racing and Gaming Commission about the specific service rather than treating an app's availability as approval.[21]
Are home poker games legal in Nebraska?
A home poker game is not automatically legal in Nebraska because the players are friends or nobody takes a rake. The gambling provisions do not establish a general private-game exemption.[6][1]
Players, as well as organizers, can face consequences for unlawful betting. The participant offense expressly applies to knowingly joining illegal gambling.[29]
A free game with no valuable stake and a contest meeting a specific prize exception are different situations. Neither provides blanket permission for a paid home game.[6]
Charitable bingo, raffles and pickle cards
A charitable purpose alone does not authorize gambling. Bingo, pickle cards, charitable lotteries, raffles and local-option keno each have their own governing framework.[4][13]
Current bingo law allows under-18 participation at limited-period or special-event games only when no alcohol is served and prizes do not exceed $50 per game. People conducting bingo must still be 18. This current threshold replaces the older $25 wording readers may encounter.[26]

Are daily fantasy sports legal in Nebraska?
Nebraska's proposed Fantasy Contests Act did not establish a licensed daily fantasy sports market. LB342 was indefinitely postponed on April 17, 2026.[16]
The general prize-contest exception has particular conditions: the value of awards must not depend on participant numbers, consideration paid or chance, and the award's value or identity must be published before competition.[6]
That is not blanket approval for every DFS or pick'em format. A brand accepting Nebraska players does not establish that its particular contest meets the law.[6][16]
Are sweepstakes casinos legal in Nebraska?
A sweepstakes label does not establish that a casino product is legal in Nebraska. The gift-enterprise statute permits conditional business promotions, including a normal-price purchase exception.[17]
Its definition excludes games including bingo, keno, slots and specified electronic or electromechanical chance-game facsimiles. A free-entry option alone therefore does not establish that a dual-currency casino complies.[17]

Are prediction markets legal in Nebraska?
Prediction-market legality in Nebraska remains contested. The state's January 2026 amicus brief opposed Kalshi's federal-law arguments in the Blue Lake tribal case.[18]
On September 16, the Ninth Circuit found the tribes likely to succeed under the Indian Gaming Regulatory Act, partly reversed the preliminary-injunction denial and remanded for the remaining factors. This was not a Nebraska-wide injunction or final trial judgment. The decision concerns tribal claims and does not settle every Nebraska event contract.[19]
What changed in Nebraska gambling law in 2026?
July changes addressed racetrack keno separation, special-event and music bingo, and Lottery vending-machine authority. Cash-device attendant requirements began August 1, while some fee changes wait until January 2027.[22]
The November sports ballot measures remain proposals as of October 3. Check their result and subsequent implementation separately.[5]
