Is Sports Betting Legal in New York? Online Betting Laws

Yes, sports betting is legal in New York through licensed mobile sportsbooks and authorized retail sportsbooks. To place a mobile bet, you must be at least 21 and physically within New York. A New York address alone does not qualify you to bet from another state.
College betting has additional restrictions: New York college teams are off limits wherever they play. Retail age requirements also differ at some tribal casinos. This guide explains those distinctions and provides official checks for the sportsbook and the bet. For other gambling products, see our New York gambling laws guide.
New York sports betting rules at a glance
| Question | New York rule |
|---|---|
| Online and mobile sportsbooks | Legal through operators authorized by the New York State Gaming Commission. |
| Where can you place a mobile bet? | Physically within New York, after the platform verifies your location. |
| Minimum age | 21 for mobile betting and commercial casino sportsbooks. Some tribal retail sportsbooks accept customers aged 18 or older. |
| New York college teams | No bets on their games, including games played outside New York. |
| Other college games | Potentially permitted, subject to the Commission's event and wager approvals. |
| High school sports | Prohibited under the state's sports wagering framework. |
The statutory rules and Commission-approved betting menu work together. A game being eligible does not mean every possible bet on that game is approved. Turning Stone's separate retail age policy is explained below.
Is online sports betting legal in New York?
Yes, online sports betting is legal in New York when you use a state-authorized operator and meet its eligibility requirements. The legal framework covers mobile and other electronic wagers placed from within the state.
Visitors can satisfy the location requirement while in New York. Conversely, a New York resident visiting another state cannot use their home address to place a New York wager. The relevant location is where the bettor is when placing the bet, not where they opened the account.
Use the New York sportsbook listed by the Commission.
You must be 21 or older and pass identity checks.
You must be physically within New York when placing the wager.
Use your own verified account. The law also restricts certain betting by people connected with the sport or wagering operation, including participants who could affect the event. Meeting the general age and location rules does not remove those restrictions.
Which sportsbooks are licensed in New York?
On 11 October 2026, the Commission's mobile sports wagering page listed these nine operators:
- Bally Bet
- BetMGM
- Caesars Sportsbook
- DraftKings Sportsbook
- theScore Bet
- Fanatics Sportsbook
- FanDuel Sportsbook
- Resorts World Bet
- Rush Street Interactive
Use the Commission's official sportsbook list to check the current names and follow its operator links. Brands change, and older guides may still show names that have been replaced. The list above records the regulator's listings on the checked date; it is not a ranking or a test of each app's availability.
Check the product as well as the company name. A brand may offer a sportsbook, fantasy contests and other services under different rules. Its New York sportsbook authorization does not extend automatically to a casino product or to every website using a similar name.
Sports betting age and retail locations
The New York sports betting age is 21 for mobile sportsbooks and the state's commercial casino sportsbooks. Do not assume that this is the minimum at every tribal retail venue: Turning Stone's official FAQ states that customers must be at least 18 to enter its gaming floor and sportsbook.
That distinction matters if an 18, 19 or 20-year-old customer can lawfully use a particular retail sportsbook. It does not make that person eligible for a New York mobile account. The phone app remains subject to the state's 21-plus requirement.
Before travelling, check the particular venue's sportsbook page for opening hours, identification requirements and house rules. Being old enough to enter a resort, restaurant or entertainment area does not establish eligibility to wager. Likewise, permission to enter a sportsbook does not override restrictions on an individual event or bettor.
The national sports betting laws guide explains why age, licensing and location checks need to be repeated when you cross state lines.
Can you bet on college sports in New York?
Yes, you can bet on some college sports in New York, but not games involving New York college teams. The prohibition follows the team wherever it plays. A game is not prohibited merely because two out-of-state colleges play it at a New York venue.
| Example | How the rule applies |
|---|---|
| Syracuse plays an away game in another state | The New York team restriction still applies. The location of the stadium does not remove it. |
| Two out-of-state colleges play in New York | The venue alone does not prohibit the game. The event and wager still need approval. |
| A tournament includes a New York college | The statute permits qualifying bets on the tournament and games that do not involve a New York college. The New York team's own game remains prohibited. |
| An individual college player's points or yards | DraftKings lists New York among states where college-player props are unavailable. The game being offered does not authorize player props. |
College-player props are restricted in New York. DraftKings' March 2026 college betting guidance lists New York among states where those wagers are not permitted. That operator guidance is consistent with the Commission executive director's January 2023 report that college-player propositions had not been authorized.
The Commission controls the approved wagering menu. Check the licensed New York sportsbook's current market and rules for the particular wager; do not infer permission from a general settlement rule covering multiple sports or jurisdictions. An offering on an offshore site does not establish New York permission.
How to check a sportsbook and an individual bet
- Open the official register. Start with the Gaming Commission's sports wagering page, then use its operator links.
- Check the actual product. Confirm that you are using the New York sportsbook, rather than a similarly branded fantasy or casino service.
- Confirm your eligibility. You need a verified personal account, must meet the age requirement and must be within New York when placing a mobile wager.
- Read the market and house rules. Check the teams involved, the type of wager and how the sportsbook settles postponed games or disputed results. Availability elsewhere is not enough.
If an operator is absent from the register, a claim that it accepts New York customers is no substitute for state authorization. Keep the bet receipt and the applicable rules if you may need to challenge a settlement later.
What changed in New York sports betting law?
New York's 2021 legislation added the mobile sports wagering framework to the existing sports betting law. The first licensed mobile sportsbooks launched on 8 January 2022.
Those are separate milestones: a law authorizing mobile wagering was followed by licensing and approval to begin taking bets. Older pages written before launch can therefore give a misleading answer to whether online betting is available today.
Complaints, account limits and self-exclusion
For an account or settlement dispute, contact the sportsbook first and keep the complaint reference, correspondence, bet receipt and relevant house rules. New York's mobile wagering law requires an initial response within 48 hours and a complete response within 10 business days.
If the issue remains unresolved or concerns compliance with the law, use the Gaming Commission's contact page for the appropriate route. Explain what happened and what response you received. A complaint does not guarantee a refund.
The mobile framework requires account safeguards, including ways to set limits and close an account. If you want a broader restriction, the Commission's voluntary self-exclusion program covers its regulated gambling activities. Check the enrollment instructions and duration before submitting the form. Do not assume that a state exclusion automatically covers every tribal property; ask the particular venue about its program.
Confidential gambling support is available through New York's HOPEline at 1-877-846-7369, or by texting HOPENY to 467369.
Frequently asked questions
Are FanDuel, DraftKings and BetMGM legal in New York?
Yes. FanDuel Sportsbook, DraftKings Sportsbook and BetMGM appear on the Commission's authorized mobile sports wagering list checked for this guide. You still need to meet the age, location and account requirements. This answer concerns their New York sportsbooks, not every other product offered under those brands.
Is sports betting legal in New York City?
Yes, eligible adults in New York City can use licensed New York mobile sportsbooks. The same state rules apply, including the 21-plus age requirement, location checks and restrictions on New York college teams. Mobile authorization does not mean that any bar or shop can operate a retail sportsbook.
Does legal sports betting mean online casinos are legal too?
No. New York's authorized mobile sports betting market does not authorize real-money online casino games. Fantasy contests also have a separate framework. See our online casino legality guide for the distinction between casino and sports betting markets.
Is New York's 51% sports betting tax charged to players?
The 51% rate discussed on the Commission's sports wagering page applies to mobile operators' gross gaming revenue. It is not a flat 51% tax on a customer's winning bet. Do not use that operator rate to calculate your own tax liability.
