Is Gambling Legal in Virginia? VA Gambling Laws in 2026

Yes, gambling is legal in Virginia through specified casino, sports betting, Lottery, horse wagering, fantasy and charitable-gaming frameworks. Private games have a narrow exception. Permission for one product does not authorize every gambling activity.[1][2][3]

Casinos, local approvals and tribal participation

Casinos are legal in Virginia at licensed establishments. The Lottery's facility-approval page lists Bristol, Portsmouth, Danville, Norfolk and Petersburg. A licence approval is not proof that a permanent resort has opened.[4][5]

Separate records report the temporary Norfolk facility opening on November 7, 2025 and temporary Live Casino Virginia in Petersburg opening January 22, 2026. Their permanent projects should not be confused with those temporary openings.[20][21]

The Norfolk filing identifies Golden Eagle's state Chapter 41 casino licence and Pamunkey participation. Tribal ownership involvement does not turn that property into a separate tribal-compact exception from the state casino framework.[20]

Use the official casino approvals to check the licensed facility, then verify its current operations with the venue.[5]

Casino slots, historical racing and skill games

Machines can look similar while operating under different laws. Check the product and its authority.[1][11][3]

The governor vetoed SB661's proposed skill-game framework on April 10, 2026. Limited amusement exceptions remain distinct; this does not mean every game involving skill is illegal.[1][14]

Is sports betting legal in Virginia?

Yes, sports betting is legal in Virginia through licensed mobile and retail channels for eligible players aged 21 or older physically in the state. Official activity reports confirm an operating market, not merely an enacted proposal.[6][22]

Virginia college-team games, youth sports and proposition bets on all college sports are restricted. A tournament exception permits other eligible games; it does not allow bets on the prohibited Virginia-team or youth games themselves.[6]

Current law also prohibits credit cards for funding sports betting accounts.[6]

Is online gambling legal in Virginia?

Some online gambling is legal in Virginia, including licensed sports betting, specified Lottery games and approved horse accounts. Casino and poker permission is more limited.[6][9][12]

On-premises mobile casino gaming

Virginia law provides for authorized mobile casino wagering while the player is verified as physically on the licensed premises. That legal framework does not establish that a particular venue has launched the service.[4][7]

Statewide remote casino and poker

Virginia does not license statewide online casinos or online poker. SB118's internet-gaming proposal failed conference on March 14, 2026. An offshore site's availability does not supply Virginia permission.[1][7][8]

How old do you have to be to gamble in Virginia?

Virginia's gambling age depends on the activity. Casinos and sports require 21; Lottery and regular horse wagering use 18. Fantasy has a transition qualification, and charitable products have several different rules.[4][6][10][11][3][17]

A parent's permission to bring a minor to a racing venue is not permission to wager. Electronic bingo-card aids are also excluded from the statutory electronic-gaming category; do not assign an age solely because a screen is used.[11][3]

Virginia Lottery tickets and online games

Virginia Lottery tickets cannot be sold to or redeemed from someone under 18, and Virginia prohibits gifting a ticket to a person under 18. An adult buying the ticket does not create a child-gift exception.[10][24]

Eligible registered players can buy specified Virginia Lottery instant and draw games online. Players must be at least 18 and physically in Virginia for online purchases and deposits, while satisfying the account requirements.[9]

These are authorized Lottery products, not permission for a private online casino offering similar-looking games.

Horse wagering and online accounts

Virginia permits regulated horse wagering, including licensed advance deposit wagering through internet and wireless accounts. ADW account holders must be at least 18.[11][12]

The Racing Commission's March 11, 2026 minutes approved four permanent ADW licences for that year. Those are actual licensing decisions, but they do not certify every website or prove that every provider's service is currently available to a particular customer.[27]

Check the Racing Commission's locations and licensing contact. HHR satellite gaming remains a separate age-21 activity within the racing framework.[11][13][28]

Is home poker legal in Virginia?

Home poker can fall within Virginia's narrow private-residence exception, but a no-rake rule alone is insufficient.[1]

The statutory conditions and definition matter:

  • The game takes place in a private residence.
  • The residence is not commonly used for such games of chance.
  • There is no statutory operator conducting, financing, managing, supervising, directing or owning the illegal gambling activity.[1]

A regular gaming operation does not gain an exemption simply by using someone's home. Read the private-residence exception and operator definition together; the statute supplies no universal weekly or monetary allowance.[1]

Bingo, raffles and charitable poker

Qualifying organizations can conduct specified charitable bingo, raffles and Texas Hold'em tournaments under Virginia's permission and operating rules. Charity status alone does not authorize a public casino or an ongoing cash poker game.[3]

A permitted Texas Hold'em tournament is distinct from cash play without a fixed end. Current law requires tournament participants to be 21, as confirmed by the 2026 chaptered amendment. Older forms showing 18 do not override that statute.[3][26]

Other charitable products have their own ages, as shown above. Ordinary bingo's accompanied-minor exception does not extend to every instant, electronic or poker product.[3][15]

Permits, registration and limited exemptions depend on the organization and activity. Use VDACS charitable-gaming guidance and its organization licensing guidance before arranging a session. An exemption does not turn a private fundraiser into unrestricted casino gambling.[3][29][30]

Are daily fantasy sports legal in Virginia?

Yes, qualifying fantasy contests have a legal framework in Virginia, but operator status and the regulatory transition matter. The current Lottery framework requires player competition, advance prizes and skill-based accumulated individual statistics. It excludes play against the operator, outcomes based on a single actual team or combination of teams, and outcomes based solely on one individual's performance in a single event.[2]

VDACS says its old statutory authority ended July 1, 2026. Qualifying existing registrations can continue while Lottery regulations are adopted and applications decided; the official regulation page still describes the new chapter as under development.[16][31][25]

The current Lottery framework uses age 21. A 2025 act made a specific exception for people aged 18 to 20 with registered-operator accounts created before July 1, 2025. These records do not settle that exception's application to every legacy account during transition. Confirm eligibility with the operator and Lottery instead of assuming the old exception continues.[2][25][17]

Check the transition notice and regulation status together. A DFS label does not approve every pick'em product.[2][16][31]

Sweepstakes casinos and prediction markets

A free-entry route does not by itself make a casino-style sweepstakes product lawful in Virginia. The gambling definition specifically addresses buying internet access, a product or another thing in exchange for a chance through a gambling device, even when a no-purchase route also exists.[1]

Prediction-market authority is disputed; federal registration is not a Virginia sportsbook permit. Virginia joined an April 24, 2026 multistate filing supporting Massachusetts's position against Kalshi. That advocacy in another state's case is not a Virginia injunction.[18]

The CFTC has argued for exclusive federal jurisdiction in a separate court filing. Its position is not a final nationwide judgment either. Those filings do not settle the legality of every platform or contract in Virginia.[19]

Match the game to the responsible authority and check the actual permission.

Casino facility

Use Lottery casino approvals. Distinguish a licence from the opening of a permanent resort.[5]

Sportsbook

Check approved sports permit holders, rather than treating a vendor authorization as a consumer sportsbook permit.[23]

Lottery game

Use the official account and game terms; physical location and other eligibility conditions apply.[9]

Racing account or HHR venue

Ask the Racing Commission about the specific permission, or call 804-966-7400.[28]

Charity session

Use VDACS session and operator information. Contact 804-371-0498 about charitable gaming concerns.[29]

Fantasy operator

Read the transition notice and confirm present status; a past registration is not a new Lottery permit.[16]
