West Virginia gambling laws distinguish products even when the Lottery regulates them. Buying an iPLAY lottery game at 18 is different from playing online casino games at 21.[5][6]

Are casinos legal in West Virginia?

Yes, casinos are legal in West Virginia. The Lottery regulates casino gaming at four racetracks and the Greenbrier resort. Casino gaming areas and play are restricted to people aged 21 or older.[1][8][20]

The four racetrack properties are Hollywood Casino at Charles Town Races, Mardi Gras Casino and Resort, Mountaineer Casino Racetrack and Resort, and Wheeling Island Hotel Casino Racetrack. Their casino permission is separate from the rules for betting on races.[2][14]

The Casino Club is for overnight guests, eligible members and specified event or convention attendees when more than 400 rooms are occupied. Being 21 does not by itself guarantee entry. Read the venue's access rules before visiting.[8]

Limited video lottery and fraternal venues

Limited video lottery is a separate licensed activity, usually involving terminals in restricted-access adult facilities. A bar, veterans organization or fraternal club does not gain gambling permission simply through its ordinary business or club status.[9]

Players must be 21. Retailers also face restrictions on allowing younger people at a terminal or in its immediate area.[10]

Can you buy West Virginia Lottery tickets online?

Yes, you can buy eligible West Virginia Lottery games online through iPLAY, including selected draw games and digital instants. It is an operating service.[6]

The terms effective March 9, 2026 require a verified account, age 18 or older and US residence. You must be physically in West Virginia to deposit funds and buy games. The requirement is US residence, not necessarily West Virginia residence.[6]

Retail ticket purchases also require age 18, but state law allows an adult to buy a ticket as a gift for a minor. That gift exception does not allow an underage iPLAY account.[13][6]

Is horse betting legal in West Virginia?

Yes, horse betting is legal in West Virginia through licensed pari-mutuel racing. People under 18 cannot wager on horse or dog races.[14]

Licensed advance deposit wagering, or ADW, is a separate electronic or telephone channel. Its statutory account-holder definition requires a resident aged at least 18, with wagering subject to licensing and federal conditions. Other racetrack account arrangements have separate rules.[15]

Check a remote provider with the Racing Commission. A casino or sportsbook approval does not establish an ADW license.[2][15]

Are home poker games legal in West Virginia?

A home poker game is not automatically legal in West Virginia because it is private or the host takes no rake. The chance-gambling prohibition expressly covers public and private places.[23]

The legal analysis depends on the game and applicable rules. The AG's 2025 opinion discusses predominant chance but does not decide every poker or skill format. Do not assume an office pool or private fundraiser is exempt merely because friends organize it.[23][17]

Charity bingo, raffles and online events

Qualifying charitable bingo and raffles are permitted under licensing rules or specific exemptions. They are not a general permission for anyone to run a gambling fundraiser.[4][16]

Online events are possible, but the details matter. Players must be physically in West Virginia. Platform providers must be licensed and registered with the Tax Division. Using a platform to produce raffle tickets requires an online raffle license. Selling traditional licensed tickets through a website is a different route, with location and federal-law cautions.[4]

Bingo play requires age 18. Annual-license rules separately allow underage attendance with an adult relative or legal guardian. Junior volunteer firefighters aged 16 or older may help their own company under the specified senior supervision. Tax guidance permits minors to participate in raffles.[4][22]

Small-raffle exemptions have organization, prize, proceeds and recordkeeping conditions. Check the Tax Division's charitable gaming guidance before advertising an event or selling tickets.[4][16]

Are daily fantasy sports legal in West Virginia?

The legal position of daily fantasy sports in West Virginia depends on the format. The Attorney General's August 6, 2025 opinion leaves important questions unresolved rather than approving every fantasy app.[17]

The opinion explains that a proposed fantasy definition considered in 2016 never became law. It analyzes a described single-player PrizePicks over/under format and initially places it within the sports-wagering definition.[17]

However, the undefined fantasy exclusion prevents a definite conclusion about the sports-wagering offense. The AG also found insufficient evidence to determine whether chance predominated in the described game.[17]

This is a qualified AG opinion, not a court ruling that every PrizePicks, Underdog or other fantasy product is legal or illegal. It also does not establish one age rule for every format. Read the full opinion when checking a particular contest.[17]

Are sweepstakes casinos legal in West Virginia?

A sweepstakes label does not make a casino Lottery-approved in West Virginia. The interactive-gaming framework requires the applicable authorization.[18]

The AG's warning about prize scams is not a legal ruling on every dual-currency casino. Do not confuse an ordinary promotional drawing with permission to operate casino games.[24][18]

Are prediction markets legal in West Virginia?

Prediction markets do not acquire West Virginia sportsbook approval simply by offering sports contracts. Their legal position involves a separate federal and state dispute.[12][19]

In February 2026, the CFTC asserted exclusive federal jurisdiction in litigation elsewhere. That agency position is not a West Virginia court ruling or state license, and does not establish a final state-specific answer for Kalshi or another platform.[19]
