Is Gambling Legal in Illinois? IL Gambling Laws in 2026

Yes, gambling is legal in Illinois through licensed casinos, video gaming, online and retail sports betting, the state lottery, horse wagering and qualifying charitable games. These permissions do not create a general licensed online casino or poker market.[1][2][3][4][5][6][7]

Illinois gambling laws distinguish the game, its operator and where it is played. This guide explains those differences; our US gambling laws guide covers the national framework.

Legal gambling uses a specific licensed or otherwise authorized route. A business registration, an app-store listing or a familiar casino brand is not sufficient on its own.

Are casinos and video gaming legal in Illinois?

Yes, licensed casinos and licensed video gaming terminals are legal in Illinois. They are separate regulated channels. Illinois casinos are not restricted to floating riverboats, despite the terminology still appearing in older guides.[2][3][16]

Casino floor

Casino gaming requires the appropriate IGB licence. Check the actual venue and licence category. A casino group's ownership or branding does not automatically establish the legal status of every related operation.[2]

Bar or other establishment

Video gaming terminals, or VGTs, can operate at qualifying licensed establishments. The machines require approval, and municipalities or counties can prohibit video gaming within their jurisdiction. A bar licence alone does not authorize the machines.[3]

Casino website

A licensed physical casino or VGT establishment does not automatically have permission to offer online slots or poker. Internet casino games require their own legal authority; a connection to a familiar venue is not enough.[7]

For machines in a bar, restaurant or truck stop, use the IGB video-gaming lists and local prohibition list. Amusement-only machines and electronic raffle devices are not the same as IGB-licensed VGTs.[3][17]

Is online gambling legal in Illinois?

Some online gambling is legal in Illinois, including licensed sports betting, official Lottery games and licensed horse account wagering. Illinois does not have a state-licensed online casino or online poker market.[1][4][5][8][7]

An online casino proposal is not an operating market. Check enacted permissions and regulator information, rather than treating a proposed bill as approval. Compare states allowing legal online gambling and casinos and the separate online poker laws guide.

Is sports betting legal in Illinois?

Yes, sports betting is legal in Illinois through authorized online and retail sportsbooks. Players must be at least 21, and online accounts require identity and eligibility checks.[1][18][19]

Use the IGB's authorized operating sportsbook table. It separates online brands, retail names and licensed entities, and marks entries that are not operational. A licence or temporary operating permit still requires approval to begin accepting wagers.[1][20]

Check the operator's location controls and permitted events. For example, bet365's Illinois rules require physical presence in Illinois and location verification. An account does not let someone wager from wherever they travel, and an advertised event is not proof every associated bet is allowed.[21]

How old do you have to be to gamble in Illinois?

The Illinois gambling age is generally 21 for casinos, video gaming and sports betting, and 18 for Lottery play and pari-mutuel horse wagering. Charitable games have their own rules.[16][3][19][4][22]

You can gamble at 18 in Illinois through some authorized activities, but not ordinary casino, VGT or sportsbook play. Being old enough does not make an otherwise unauthorized website legal.

Lottery and horse wagering

Can you buy Illinois Lottery tickets online?

Yes, Illinois Lottery tickets for supported games can be bought through the official online service. Online registration requires Illinois residency, and each purchase requires physical presence in Illinois.[4]

The Lottery offers online draw games, including Fast Play. Its description of Fast Play as a draw game should not be confused with permission for an unrelated online casino. Check the official gaming safeguards before registering.[4][23]

Licensed advance deposit wagering, or ADW, is a legal online horse-betting channel in Illinois. The Racing Board's August 2026 report records actual wagering activity, rather than merely a proposed service.[5][9]

Use the IRB's ADW page for checking information. Confirm current permissions and schedules: an older operator list or racing-date award is not proof a venue still operates. The Board acknowledged Hawthorne's closure when rejecting its 2027 application.[24]

Home poker and charitable games

Illinois does not provide a general home-poker exemption simply because friends play privately or for small stakes. The gambling prohibition has specific exceptions; a private location does not itself create one.[8]

Poker conducted under an authorized casino or charitable-game framework is a different situation. A friendly description, no-rake arrangement or fundraising purpose should not be substituted for checking the actual legal exception and operating requirements.[6][8]

Illinois permits qualifying charitable gaming, with different licensing routes for different games. The Department of Revenue regulates charitable bingo, pull-tabs and specified charitable games. Its permitted charitable-game list includes poker, blackjack and roulette, but that does not authorize any individual to run a casino night.[6][10][11]

The organization must qualify and follow the event rules. IDOR limits licensed charitable-game organizations to four events annually and provides a licence lookup. Raffles use local licensing routes; Cook County's guidance is an example for its unincorporated areas, not a universal statewide permit.[6][25]

Fantasy, sweepstakes and prediction markets

Illinois introduced a dedicated regulatory framework for fantasy contests in 2026. In September, the IGB announced proposed implementing rules following amendments to the Sports Wagering Act. It distinguished fantasy contests from sports gambling and described further rule review through JCAR.[12]

Check current IGB requirements rather than assuming every fantasy operator or format is approved. The Illinois Supreme Court's 2020 decision in Dew-Becker v Wu concerned the particular head-to-head contest before it. That historical skill-based ruling does not replace the new framework or determine every modern pick'em product.[26][12]

A sweepstakes casino label does not establish legal authorization in Illinois. In February 2026, the IGB told ACE that its unlicensed prize-paying online slots violated Illinois gambling law. It demanded that the operator block Illinois users or stop offering redeemable prizes.[7]

That is a specific regulator enforcement position, not a final court judgment banning every free promotional giveaway. Sports prediction markets involve contested state and federal authority in Illinois. The IGB's published position treats unauthorized sports-contract activity as gambling. The CFTC filed a federal challenge in April 2026, while Kalshi's June complaint challenged new Illinois legislation.[13][14][15]

Those documents state agency and litigant positions; requests for injunctions are not proof that an injunction was granted. This guide does not establish a current enforcement standstill or final resolution. Federal registration, a tax provision or a platform accepting Illinois customers does not by itself establish an IGB sportsbook licence.

How to check an Illinois gambling licence

Match the operator, product and operating status. A licence application or approval for another activity is not enough.

Casino, sports or machines

Use the IGB's casino lists, operating sportsbook table or video-gaming lists. Match the business and location, then distinguish applications from licences and operating permission.

Lottery or horse account

Start with the official Lottery safeguards or Racing Board ADW page. These are separate channels; a sports-betting licence does not substitute for either one's requirements.

Charitable event

Use IDOR's gaming licence lookup and charitable-game guidance. Check the sponsoring organization and game. For a raffle, identify the relevant local licensing authority.

For concerns about IGB-regulated activity, use its prohibited-conduct reporting route. Keep the operator name, transaction details and correspondence.

The IGB self-exclusion page explains enrollment and support routes. Check its current coverage. September's proposed changes did not immediately extend the existing casino/sports program to video gaming, so do not assume one enrollment already covers every product.[27][12]

Recent changes and what to check next

Checked October 3, 2026. The new fantasy framework, its implementation rules and prediction-market litigation need separate current checks. An online casino bill is not an operating market, and an old racetrack schedule is not proof a venue remains open. Use the relevant regulator's latest information before relying on an older legal summary.[12][24]
