Service providers need to be confident that their terms and conditions reduce their liability in relation to unlawful use of their services by their clients (for example, sending spam contrary to the Privacy and Electronic Communications (EC Directive) Regulations).
Where a service provider is reselling another person’s services, they also need to be confident that their terms and conditions are “back-to-back” with those of the ultimate supplier of services.
Customers need to be sure that they will receive the service they are paying for, and that any marketing databases supplied by the service provider have been created in accordance with the law.
