Is Online Gambling Legal in New York? Online Casino Laws

Yes, some online gambling is legal in New York, but real-money online casinos are not authorized. Licensed mobile sportsbooks can accept sports bets. That permission does not extend to online slots, blackjack, roulette or live-dealer casino games, even when both products use the same brand.
New York also prohibits the dual-currency sweepstakes casino model defined in its 2025 law. Free-play games without redeemable prizes are a different product. This guide explains those distinctions, what the online casino bills would change and how to check an operator's claims. For the wider picture, see our New York gambling laws guide.
Are online casinos legal in New York?
No, real-money online casinos are not legal in New York. The state has not authorized a regulated internet casino market. The Gaming Commission's current guidance identifies online casinos, including those claiming to be sweepstakes, among unlawful online gambling products.
That matters when an app offers several different services. A company can hold permission to accept sports bets in New York while offering casino games only in other states. Its New York sportsbook approval does not authorize every game in its app. A separate casino tab, an advertisement or a working deposit button does not change that.
New York's gambling law looks at what the customer stakes, how the outcome is decided and what can be won. Calling a payment a coin purchase or a game a promotion does not settle the legal question. Nor does a licence issued by another country establish New York approval.
For example, seeing DraftKings or FanDuel on the state's sportsbook list supports their sports wagering permission. It is not evidence that you can play their real-money online casino games while in New York. Check the product as well as the company.
Which online gambling products are different?
The word "gambling" covers activities with different legal permissions. Use the product description, rather than the appearance of the game, to understand what is being offered.
| Product | Position in New York | What to check |
|---|---|---|
| Real-money online casino | Not authorized |
Slots, blackjack and live-dealer games are not covered by a sportsbook licence. |
| Mobile sports betting | Permitted through licensed operators |
Check the current official operator list and the sportsbook's eligibility requirements. |
| Dual-currency sweepstakes casino | Prohibited under the statutory definition |
Cash and cash-equivalent redemption matter, including chances to win redeemable prizes. |
| Social game without redeemable prizes | Different from a cash-prize casino |
Check for cash-outs, gift cards, prize entries and any other rewards before assuming it is entertainment-only. |
| Physical casino | Separate land-based permission |
A venue's casino licence does not authorize an online casino throughout New York. |
A social game with no redeemable reward is different from a site selling entertainment coins alongside cash-prize credits. Adding a separate reward system can change the analysis. "Social" and "free to play" are marketing descriptions, not proof of legal approval.
Sports betting has its own age, location and account rules. Our New York sports betting guide covers those requirements. Poker and fantasy contests also need their own product-specific checks.
How to check what a gambling licence covers
Start with the regulator's information, then compare it with the exact service you want to use. There is no New York licensed online-casino market to verify against a casino-app list.
- Identify the game. Is it a sports wager, a cash-prize slot, a nonredeemable social game or something else? An operator's general description can obscure the product you are actually paying for.
- Open the relevant official list. For a sportsbook, use the Gaming Commission's sports wagering page. A listing there confirms the product it names, not a separate casino service.
- Match the company and destination. Compare the operator's identity and official website with the app or domain you have opened. A similar name, logo or sponsored search result is insufficient.
- Read the product's location rules. Permission in another state does not transfer with your account. An app-store download, a successful login or a VPN does not establish New York authorization.
If the site relies only on its availability map or a foreign licence, it has not demonstrated New York online casino permission.
When will online casinos be legal in New York?
There is no confirmed date for legal online casinos to launch in New York. As checked on October 26, 2026, the legislature's records show these proposals in committee:
Senate bill S2614
Proposes an interactive-gaming framework. Its current record shows referral to the Senate Racing, Gaming and Wagering Committee on January 7, 2026. It is a proposal, not an authorization to accept casino bets.
Assembly bill A6027
The companion proposal is in the Assembly Racing and Wagering Committee, with a January 7, 2026 referral. It does not establish a current online casino licensing scheme or a launch date.
Passing legislation, implementing a licensing system and opening approved services are different steps. A proposed tax rate, licence condition or gambling age should not be presented as a rule for a market already operating.
The sweepstakes ban and new physical casino developments do not themselves legalize internet casino play. Treat a predicted launch year as a forecast unless it is supported by an enacted framework and official implementation announcement.
Offshore casinos and player protection
An offshore casino may accept New York registrations or payments without having New York authorization. Its availability is not evidence of legality. Using cryptocurrency, a foreign address or location-masking software does not supply the missing permission.
The practical risk is also different from using a licensed service: a disputed withdrawal, closed account or missing balance may leave you without the regulator-backed protections you expected. Keep the operator's identity and jurisdiction in view, not just its advertised payout speed.
New York's gambling offences distinguish ordinary players from people who advance or profit from an unlawful gambling operation. That distinction does not make the operator lawful or guarantee recovery of a player's money. Promoting or helping run a service is different from simply being its customer.
What to do about an online casino dispute
If a casino will not resolve an account or withdrawal problem, preserve the evidence before messages or account access disappear.
- Save the site's address, operator name, account statements, payment records and the terms that applied when you paid.
- Contact support in writing. Describe the disputed amount and request a clear explanation of the account or withdrawal decision.
- Use the New York Attorney General's consumer complaint route to report the issue, including your records and the operator's responses.
A complaint does not guarantee repayment. Avoid paying a new fee simply because someone promises to release a balance. The Gaming Commission's Play Safe resources provide gambling-support information if you need help managing your play.
New York online casino questions
Are online slots legal in NY?
Real-money online slots are not authorized in New York. A licensed sportsbook does not have permission to offer them simply because they appear in the same app. Nonredeemable free-play slots are a different product.
Is DraftKings Casino legal in New York?
DraftKings' New York sportsbook permission does not authorize DraftKings Casino in the state. The same product distinction applies to FanDuel and other brands that offer both sports betting and casino games in different markets.
What is the legal age for online casinos in New York?
There is no age at which an otherwise unauthorized New York online casino becomes legal. Being 21, or meeting a site's own age requirement, does not create state permission for its casino games.
Does "no purchase necessary" make a casino legal?
No. Free-entry wording does not exempt a dual-currency casino from New York's sweepstakes prohibition. Check how the currencies, games and redeemable prizes work, rather than relying on the promotional label.
Does a New York casino licence cover its online games?
A physical casino licence does not authorize a statewide internet casino. Check the specific product permission; the casino's name, loyalty account and land-based approval do not answer that question.
