Are Sweepstakes Casinos Legal in New York? NY Laws in 2026

No, sweepstakes casinos using the dual-currency cash-prize model defined by New York law are not legal in New York. The state prohibits operating, conducting or promoting those games and specified support for them. The prohibition took effect on December 5, 2025.
That does not mean every ordinary prize draw or free social game is a banned casino. The currency system, games and rewards matter. This guide explains the ban, the distinction between operators and players, and what to do about an existing account. Our New York gambling laws guide covers the broader rules.
What the New York sweepstakes casino ban covers
New York's law defines an "online sweepstakes game" by combining three features. A product's name is less useful than following how it works from access through to redemption.
Online or device access
The game, contest or promotion is available through the internet or accessible on a phone, computer terminal or similar device. The rule is not limited to a downloaded casino app.
Dual-currency prize system
The payment system allows currency to be exchanged for cash, cash equivalents or a chance to win them. The Gaming Commission determines what constitutes a dual-currency system under the law.
Casino-style play
The product simulates casino-style gaming. The listed examples include slots, video poker, table games, lottery games, bingo and sports wagering, rather than only traditional online slot machines.
The familiar model uses one currency for entertainment and another for prize play. A player might buy Gold Coins and receive Sweeps Coins alongside them, with the second currency leading to cash redemption. Different coin names do not change the underlying questions.
Free entries are not an express exception in section 912. Nor does switching to one advertised currency automatically establish legality: a product outside this particular definition can still raise issues under New York's other gambling laws.
Cash-equivalent rewards matter too. A gift card or another redeemable benefit should not be treated as harmless merely because the site does not call it cash. Check the full reward system, including what winning credits can eventually buy or unlock.
When did New York ban sweepstakes casinos?
New York's specific sweepstakes casino prohibition became effective on December 5, 2025. Earlier enforcement relied on existing gambling law, so the signing date is not evidence that the business model was lawful before then.
March 7, 2025: enforcement letters
The Attorney General's cease-and-desist letter described virtual casino games and redeemable coins as unlawful gambling under existing law. It rejected the argument that obtaining some coins free removed their value.
June 6, 2025: action announced
The Attorney General announced that 26 online sweepstakes casinos would end sales of sweepstakes coins in New York following cease-and-desist action. This was enforcement against the identified platforms, not the later statute's effective date.
December 5, 2025: law signed
S5935A became chapter 605, adding section 912 to New York's Racing, Pari-Mutuel Wagering and Breeding Law. The final act took effect immediately, rather than creating a future launch or grace period.
An operator's separate account-closure or redemption deadline may differ from these legal milestones. Check its dated notices rather than assuming every platform used one deadline.
Sweepstakes, social games and ordinary promotions
The ban concerns a defined casino-style product. These distinctions help when a site uses "sweepstakes" or "social" to describe itself.
| Product | What distinguishes it | What the distinction does not prove |
|---|---|---|
| Dual-currency sweepstakes casino | Online casino-style play with currency exchangeable for cash, cash equivalents or chances to win them |
Free entries do not supply an express exemption from section 912. |
| Social game without redeemable prizes | Entertainment play without cash-out or a redeemable prize system |
The word "social" alone does not prove that rewards are nonredeemable. Read the actual rules. |
| Ordinary promotional sweepstakes | A promotion connected to goods or services, governed by separate promotional rules |
Registration or promotional wording does not authorize an online casino. |
A genuinely nonredeemable game lacks the prize-redemption feature described above. But a social-game label is unreliable if another part of the platform awards cash, gift cards or redeemable credits. Evaluate the connected features, not just the first screen.
New York has separate rules for qualifying consumer promotions, including registration and security requirements for certain higher-value promotions. Those rules are not a casino licence. This distinction also does not create a blanket exemption for subscription games, mystery boxes or single-currency sites.
Who does the law apply to?
Section 912 prohibits operating, conducting or promoting the defined games within New York. It also prohibits specified businesses from supporting their operation or promotion, including payment processors, financial institutions, geolocation providers, game-content suppliers, platform providers and media affiliates. It reaches beyond the company whose name appears on the casino homepage.
Violations carry fines of $10,000 to $100,000 per violation, with possible loss of a gaming licence or ineligibility for one. The Gaming Commission, State Police and Attorney General have enforcement powers. Those penalties should not be described as an automatic fine owed by every customer who played a game.
Ordinary bettors and people helping run a gambling operation are treated differently. In its March 2025 enforcement letter, the Attorney General explained that the Penal Law gambling provisions focus on bookmakers and operations, rather than imposing criminal liability on individual bettors. That is a limited distinction about those provisions, not general immunity for fraud, promotion or other conduct. It also does not make the platform licensed or its balances protected.
What if you still have a sweepstakes casino account?
If an old account remains accessible, do not assume that access means prize play has been approved. A site may retain account records or entertainment-only features after changing its New York service.
- Save your records. Keep screenshots or downloads of balances, purchases, redemption requests, account notices and applicable terms. Include dates and the legal entity named by the operator.
- Check the operator's notices. Look for New York restrictions and any historical redemption deadlines. A notice about one currency does not necessarily describe every balance on the account.
- Ask support for a written answer. Identify the disputed balance or withdrawal and request its status. Do not buy more coins to test whether the site still works.
- Report an unresolved problem. The Attorney General's consumer complaint service is an official reporting route. Include the transaction history and relevant correspondence, not just the site's brand name.
A complaint is not a guarantee of repayment. Changing your location details or using a VPN does not restore lawful New York prize play or resolve a dispute over funds.
What remains permitted in New York?
New York permits mobile sports wagering through licensed operators. Check the Gaming Commission's current sportsbook list, then the relevant account and location rules. Sportsbook approval does not cover online casino games.
Our New York sports betting guide explains that separate framework. For help managing gambling, the Commission's Play Safe page provides official support resources. A switch to another gambling product is not a solution to a problem with your play.
Common questions about New York sweepstakes casinos
Are free sweepstakes casinos legal in New York?
Free entry does not exempt a casino that fits section 912. A game without redeemable prizes is different. Examine its currencies and rewards, not just the word "free".
Can a casino avoid the ban by changing its coin names?
A name change does not determine the result. The law addresses how the payment and prize system works, and the Gaming Commission determines what constitutes a dual-currency system. Marketing terminology does not establish approval.
Is Global Poker legal in New York?
Global Poker was among the platforms named in the Attorney General's June 2025 action. That historical record concerns its sweepstakes casino offering. An accessible account or entertainment-only feature does not establish permission for cash-prize play.
Can sweepstakes coins be redeemed for gift cards instead?
The definition includes cash equivalents and chances to win them. Substituting gift-card redemption for cash is not a reliable way to place an otherwise covered dual-currency casino outside the prohibition.
Did New York ban every sweepstakes promotion?
No. The law defines an online casino-style dual-currency product. Ordinary promotions have their own rules. Calling a product a sweepstakes does not exempt it from the law.
